Abstract

This paper analyzes new developments in the field of health assistance, in the light of recent judicial rulings in Uruguay. It addresses, first, the new abbreviated procedure for requesting pharmaceuticals from the Ministry of Health, which establishes a limited list of drugs, unlike the previous procedures. Second, it refers to the new interpretation of the concept of "lack of resources," whose scope would allow persons to access drugs via government assistance and could establish co-payment for medications on a case-by-case basis. Third, it looks at the principle of sustainability, insofar as the Uruguayan courts have recently come to different assessments on the subject.
