The vegetable breeder and the producer

an approach from a practical perspective

Abstract

Intellectual creations -and specially those connected to biotechnology- is an area that in our country has been given importance, due to several factors. Hence, it is important to understand which is the role that the people who intervenes in these creations (plant varieties) play, as well as its trading and contractual relationship. Also, these parties (vegetable breeder and producer) are entitled to different rights over these varieties: the breeder’s creation are legally protected and the producer has to pay to the breeder a fee for the multiplication of the varieties and eventually for producing new varieties from those and trading them. All of the above must be strictly foreseen in a technological value agreement, being the Seeds National Office the regulatory entity and the Uruguayan Association for the protection of plant varieties that intervenes on behalf of vegetable breeders to control the enforcement of the agreement.
