Abstract

Artificial Intelligence (AI) technologies use data as part of their processes for training and defining solutions. In the case of data whose content is made up of works protected by Copyright, it is not appropriate to understand that works are “used”. AI does not make use of works as in the physical or digital world. The process of analyzing and processing data in AI is analogous to the mental process of inspiration. Just as inspiration in other people’s works is not deemed use of a work and is the starting point for works protected by Copyright, the training of data representative of protected works must also be understood as inspiration.
