Danza y propiedad intelectual, registro como marca de movimiento y el caso Moonwalk

El artículo plantea en primer lugar las facetas de la danza enfocadas hacia el análisis de las distintas posibilidades de protección por la propiedad intelectual de manera general. Luego, en particular se analizan distintas creaciones involucradas, explicando el abanico de derechos correspondientes a los titulares de derechos: coreografía; bailarines; directores y otros roles en la preparación o producción de un espectáculo de danza; elementos escénicos y complementarios. También se presenta la especial protección legal de las danzas folklóricas y tradicionales. A ello se agregan consideraciones sobre los desafíos de las nuevas tecnologías para la protección legal de la danza. En segundo lugar se analiza la posibilidad de protección de coreografías, secuencias de pasos o movimientos por medio de la marca de movimiento. En tercer lugar, se toma el caso particular de la coreografía y del paso conocido como Moonwalk para plantear un análisis de sus posibilidades de protección por derechos de autor, marca o competencia desleal. Finalmente, reflexionamos sobre las ventajas y limitaciones de los distintos sistemas de protección de la propiedad intelectual en relación con elementos creativos de la danza.
