Dança e propriedade intelectual, registro como marca de movimento e o caso Moonwalk

O artigo primeiro discute as facetas da dança, concentrando-se na análise das diferentes possibilidades de proteção da propriedade intelectual em geral. Em seguida, são analisadas, em particular, as diferentes criações envolvidas, explicando a gama de direitos correspondentes aos detentores dos direitos: coreografia; dançarinos; diretores e outras funções na preparação ou produção de um espetáculo de dança; elementos cênicos e complementares. A proteção legal especial das danças folclóricas e tradicionais também é apresentada. Em segundo lugar, é analisada a possibilidade de proteger coreografias, sequências de passos ou movimentos por meio da marcação de movimento. Em terceiro lugar, tomamos o caso específico da coreografia e do passo conhecido como Moonwalk para analisar as possibilidades de proteção por direitos autorais, marca registrada ou concorrência desleal. Por fim, refletimos sobre as vantagens e limitações dos diferentes sistemas de proteção à propriedade intelectual em relação aos elementos criativos.
